Terms of Use
These Terms of Use (“Terms”) are an agreement between you and HVNT33 (“HVNT33,” “we,” “us” or “our”). They govern the HVNT33 website, Investigations newsletter, HVNT33 Cloud, Hunter, community features and related services (together, the “Services”). HVNT33 Desktop is also distributed under the GNU Affero General Public License, version 3; where that license and these Terms address the same copy of the open-source software, the license controls.
1. Acceptance and eligibility
By using a Service, creating an account, joining a restricted community area or purchasing a Founding Membership, you agree to these Terms and the Acceptable Use Policy. You must be at least 18 years old and legally able to enter a contract to make a purchase. If you act for an organization, you represent that you may bind it.
2. The Services
HVNT33 Desktop is a local-first investigation browser. HVNT33 Cloud is an optional hosted service for storing cases, collaborating and publishing selected material. Cloud is in development. Features described as planned, preview, beta or early access may change before general availability. We will not make private case material public merely because it is stored in Cloud; publication requires an affirmative publishing action by an authorized user.
3. Founding 100 purchase
The Founding Membership is a one-time purchase of USD $199, not an automatically renewing subscription. It includes one year of HVNT33 Cloud beginning on the date we activate your Cloud account, not the purchase date, plus the benefits listed on the Cloud page when you purchase. We will send activation information to the email address used at checkout.
No specific activation date is promised unless we give you one in writing. You may obtain a full refund at any time before activation and for 30 calendar days after activation under the Refund Policy. If we accept more paid purchases than the stated Founding 100 limit, we may either honor the same benefits or promptly offer a full refund.
4. Payments and taxes
Managed Payments by Stripe processes the Founding Membership transaction, and Stripe is the merchant of record for that transaction. Checkout may present local currency, payment methods, taxes and Stripe or Link terms based on your location. Stripe sends transaction receipts, invoices and refund notices. HVNT33 remains responsible for providing the product, activation, product support and the refund promise in these Terms. Do not send payment-card details to HVNT33.
5. Accounts and security
You are responsible for accurate account information, protecting credentials and activity under your account. Notify us promptly if you believe an account or purchase link has been compromised. We may require reasonable verification before changing access, connecting Discord or disclosing account information.
6. Your research and content
You retain ownership of material you submit to the Services. You give HVNT33 a limited license to host, copy, process, transmit and display that material only as needed to provide, secure and improve the Services, follow your instructions and comply with law. If you affirmatively publish material, you also authorize us to make that published material available to the public until you unpublish or delete it, subject to reasonable archival, legal and technical limits.
You represent that you have the rights and lawful basis needed to collect, upload, share and publish your material. Investigation tools do not create an exemption from privacy, intellectual-property, confidentiality, court-order, sanctions or other laws.
7. Sensitive research
Do not place credentials, payment-card data, authentication secrets, highly sensitive personal data or material whose disclosure could endanger a person into public pages, Discord or support email. Before Cloud documentation expressly supports a category of regulated or highly sensitive data, do not upload it to Cloud. Local Desktop cases remain under your control, subject to the behavior described in the documentation.
8. Hunter and generated material
Hunter and other automated features can be incomplete, inaccurate or misleading. Treat generated material as a research aid, preserve sources and verify important claims. Do not use generated material as the sole basis for legal, medical, financial, employment, housing, credit, insurance or other high-impact decisions about a person.
9. Community and Discord
Discord participation is optional and also subject to Discord’s terms. A paid Founding Membership may be connected to one Discord account for the Founding 100 role and private channel. Community access has no separate cash value, may be unavailable because of a third-party outage and may be suspended for violations of these Terms or the Acceptable Use Policy. Removing community access does not remove any non-waivable refund or consumer right.
10. Newsletter and service email
The Investigations newsletter requires separate confirmation and can be unsubscribed from at any time. Purchase receipts, security notices, activation messages and material changes to an existing membership are transactional messages and may still be sent when needed to perform the contract or comply with law.
11. Intellectual property
Except for open-source components and your content, HVNT33 and its licensors own the Services, branding, site design and non-public software. These Terms do not grant a right to use HVNT33 names or marks in a way that suggests endorsement. Open-source rights come from the applicable license, not these Terms.
12. Suspension and termination
You may stop using the Services at any time. We may restrict or suspend access when reasonably necessary to protect users, sources, the Services or third parties; investigate suspected abuse; comply with law; or address a material breach. When practical, we will give notice and a chance to cure. On termination, provisions that by their nature should survive, including ownership, payment obligations, disclaimers, liability limits and dispute provisions, continue to apply.
13. Availability and changes
We aim to provide a durable research service, but no online service is uninterrupted. We may maintain, secure, replace or discontinue features. If a material change substantially reduces a paid Founding benefit during its included year, we will provide an appropriate remedy, which may include restoration, a substitute benefit, service credit or refund as required by law.
14. Disclaimers
To the maximum extent permitted by law, the Services are provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that search results, archives, generated material or published investigations are complete, accurate or suitable for a particular investigation. Nothing in these Terms excludes warranties or remedies that cannot lawfully be excluded.
15. Limitation of liability
To the maximum extent permitted by law, HVNT33 will not be liable for indirect, incidental, special, consequential or punitive damages, or loss of profits, revenue, goodwill or data. HVNT33’s aggregate liability arising from a paid Service will not exceed the amount you paid for that Service. These limits do not apply where prohibited by law or to liability that cannot lawfully be limited.
16. Indemnity
To the extent permitted by law, if you use the Services for an organization, you will defend and indemnify HVNT33 against third-party claims arising from your unlawful content, publication decisions or material violation of these Terms. This section does not apply to individual consumers where prohibited by law.
17. Changes and contact
We may update these Terms prospectively. If a change materially affects an existing paid membership, we will give reasonable notice and state when it takes effect. Questions may be sent to kai@hvnt33.com.
